What is marriage fraud?
Marriage fraud is essentially when one or both parties to the marriage enter(s) the marriage solely for
to get US immigration benefits.
Marriage fraud does not occur when a once legitimate marriage goes south. Even though
your spouse may have told you in a fit or rage several years into the marriage that s/he only married you for immigration, that does
not make it so. To substantiate a claim of marriage fraud you need more significant evidence. For instance,
evidence that your spouse was emailing communicating with a former boyfriend/girlfriend, written admissions to marriage fraud,
etc.
What can I do to protect myself against marriage fraud?
The most basic
steps to protecting yourself against marriage fraud are to take your time and really get to know your fiance rather than rushing into
a marriage with a person with whom you have spend very little face-to-face time. This is common sense. You would not marry
a total stranger who lived in the US. The same concept exists with foreign spouses. You need to actually get to know the
person like you would any other potential spouse.
What can I do if I am the victim of marriage fraud?
My office offers
a service of filing a complaint of marriage and immigration fraud with the US government. The benefits of this service are the
potential removal of your spouse from the US, denial of subsequent immigration benefits for the previous spouse, or possible removal

What are some of the indicators of fraud?
1) Filed for divorce immediatley after receiving greencard.
2) False and unsubstantiated allegation of abuse: financial, physical, or emotional.
