Below are the basic steps in the Marriage Visa process:
 
1) Assemble your supporting documents
 
2) Meet the Marriage Visa Requirements
    a) personal meeting within last 2 years
    b) No Felony Convictions by either party
    d) Additional Requirements
 
3) Complete the initial petition
 
4) File your initial petition with USCIS
 
5) 2-4 weeks receive your receipt notice with your case tracking number
 
6) 4-6 months receive your approval notice for your initial petition
 
7) 1-2 months NVC processing
 
8) Receive your consular packet and schedule your consular inteview
 
9) Consular Interview 2-4 months after consular packet is received
 
10) Get your Marriage Visa - Same day - 2-4 weeks in most cases
 
Please note, if you are a legal permanent resident and not a citizen, the marriage visa will take up to 5 years due to numerical limitations on visas for non-citizen's spouses.

Marriage Visa Requirements
To qualify for a Marriage Visa both the petitioner (US Citizen or LPR) and the beneficiary (Foreign Spouse) must meet certain requirements.  Among these requirements are:
 
1) Financial ability to sponsor the Spouse
2) Moral Fitness of Spouse - i.e. no criminal record
3) In Person Meeting within the last 2 years
4) Physical Health of Spouse - i.e. no communicable diseases like AIDS or TB
5) Permission to bring children (if relevant)
6) For naturalized persons, Sponsor can either prove that previous marriage was bona fide or more than 5 years have past since receiving LPR status based on marriage to US citizen.
