Frequently Asked Questions:

The following information should answer many of the questions you have about the "K-3 visa" process. Please contact 800-681-2311 to discuss any additional questions you may have.

How long will it take to bring my spouse here?

The process usually takes 8-12 months from start to finish.

After a "K-3 visa" is issued, how long does my spouse have to come to the US?

The "K-3 visa" visa is valid for up to 6 months after it is issued. For this reason, your spouse's passport must be valid for at least 6 months after his/her "K-3 visa" interview date.

Can my spouse bring his/her children to the US?

Yes. You can petition separately for your step-children if they meet certain age and other requirements.  They can come as a “derivative” on the K-3 visa (K-4) if you file a separate I-130 application for each child.

Can my fiance bring other relatives to the US?

No. The "K-3 visa" does not allow your spouse to bring other relatives to the U.S. Your spouse can only bring his/her unmarried children who are under age 21 to the US until s/he becomes a citizen. Once that happens, you spouse will be eligible to bring his/her parents, married children, adult children, and brothers and sisters to the US. Unfortunately, you cannot apply to bring your spouse's relatives because people are not able to petition for their in-laws.

Can my spouse work on a K-3 visa?

Once in the US on the "K-3 visa", your spouse can apply for a EAD - a work permit. However, the work permit will take about 30-90 days to be issued.  By that time you should have the green card and therefore it is often a waste of time and money to apply for an EAD.

Can my spouse leave the country on a "K-3 visa"?

Yes and No.  There is nothing that will legally prevent your spouse from leaving the country on the K-3 visa. The problem is that without “advance parole” or the green card, your spouse cannot reenter the US.

How long after the interview will the "K-3 visa" be issued?

Many countries issue “K-3 visas” the same day or within 3 days, but some countries may take up to 3 weeks to process the visa and return it to your fiance. Each embassy is different.
