K-1 Fiance Visa Basics
 
Below are the basic steps in the K-1 "Fiance Visa" process:
 
1) Assemble your supporting documents
 
2) Meet the Fiance Visa Requirements
    a) personal meeting within last 3 years
    b) U.S. Citizenship of US Fiance
    c) No Felony Convictions by either party
    d) Additional Requirements
 
3) Complete the initial petition
 
4) File your initial petition with USCIS
 
5) 2-3 weeks receive your receipt notice with your case tracking number
 
6) 3-5 months receive your approval notice for your initial petition
 
7) 1-2 months NVC processing
 
8) Receive your consular packet and schedule your consular inteview
 
9) Consular Interview 1-3 months after consular packet is received
 
10) Get your "Fiance Visa" - Same day - 2 weeks in most cases

How long will it take to bring my fiance here?

The process usually takes 5-10 months from start to finish.

 

After a "K-1 visa" / "Fiance Visa" is issued, how long does my fiance have to come to the US?

The "K-1 visa" / "Fiance Visa" visa is valid for up to 6 months after it is issued. For this reason, your fiance's passport must be valid for at least 6 months after his/her "K-1 visa" / "Fiance Visa" interview date.

 

How long do we have to get married?

Once your fiance enters the United States on his/her "K-1 visa" / "Fiance Visa", you will have 90 days to marry.

 

What happens if we don't get married within 90 days?

If you fail to marry your fiance within 90 days, the "K-1 visa" / "Fiance Visa" is expired and your fiance should leave the country. You will need to start the entire "K-1 visa" / "Fiance Visa" process over again and apply for a new "K-1 visa" / "Fiance Visa" visa.

 

Can my fiance bring his/her children to the US?

Yes. The "K-1 visa" / "Fiance Visa" allows your fiance to bring his/her children to the US at the same time s/he comes if they apply for a K-2 visa. They may also be able to come up to one year after your fiance's "K-1 visa" / "Fiance Visa" is issued if they apply for a K-2 visa.

 

Can my fiance bring other relatives to the US?

No. The "K-1 visa" / "Fiance Visa" does not allow your fiance to bring other relatives to the U.S. Your fiance can only bring his/her unmarried children who are under age 21 to the US until s/he becomes a citizen. Once that happens, you fiance will be eligible to bring his/her parents, married children, adult children, and brothers and sisters to the US. Unfortunately, you cannot apply to bring your fiance's relatives because people are not able to petition for thier in-laws.

 

Can my fiance work on a K-1 visa?

Once in the US on the "K-1 visa" / "Fiance Visa", your fiance can apply for a EAD - a work permit. However, the work permit will take about 30-90 days to be issued and once you are married, your fiance will need to apply again. Some immigration officers will deny work permits because of this. Your fiance should wait until after your marriage, when you file the adjustment of status paperwork to apply for an EAD. There is no reason to waste $170.00 applying for a work permit before your adjustment of status is filed.

 

Can my fiance leave the country on a "K-1 visa" / "Fiance Visa"?

No. Your fiance canonly enter the country one time on the "K-1 visa" / "Fiance Visa". If s/he leaves before you are married, you will have to file a new "K-1 visa" / "Fiance Visa" petition. After you are married, your fiance will need to apply for "advance parole" to travel until your adjustment of status application is approved. If your fiance leaves the country without advance parole, s/he may not be allowed to return.

How long after the interview will the "K-1 visa" / "Fiance Visa" visa be issued?

Many countries issue "K-1 visa" / "Fiance Visa" visas the same day or within 3 days, but some countries may take up to 3 weeks to process the "K-1 visa" / "Fiance Visa" visa and return it to your fiance. Each embassy is different.
